Article 1 SCOPE OF APPLICATION

1.1 These general terms and conditions of sale govern the relationship between Amazonia.ch AG and the Internet user, hereinafter referred to as the customer. The masculine form “customer” used hereinafter naturally refers to both customers and clients.

1.2 Sending the order to the customer implies acceptance of these terms and conditions in their entirety, to the exclusion of any other terms or conditions. The customer declares that he/she has the capacity to enter into a contract with Amazonia.ch AG on the basis of the general terms and conditions of sale. The customer warrants that all information provided is accurate.

1.3 Registration on the http://www.amazonia.ch, online shop website is reserved for persons with legal capacity. The data required for registration must be complete and truthful. Customers are responsible for updating their own data.

Article 2 PRODUCTS

2.1 The products sold are described on the http://www.amazonia.ch website. The characteristics of the articles and the explanatory notes are given for information only and do not constitute contractual documents. The photos on the http://www.amazonia.ch website are for illustrative purposes only and do not form part of the contractual conditions. Amazonia.ch SA accepts no responsibility for any errors or omissions in the images or notices appearing in its online store.

2.2 The goods sold are of impeccable quality. Products are sold with no warranty other than that of the manufacturer.

Article 3 PRIZES

3.1. The prices displayed on the http://www.amazonia.ch website include VAT at the rate in force at the time of ordering. Prices are in Swiss francs and do not include delivery charges.

3.2. Amazonia.ch AG reserves the right to change prices at any time. However, the price invoiced for delivered products is the price in effect at the time the order is placed. This is shown on the order confirmation sent to the customer.

3.3. Promotional discounts offered as part of sales campaigns on the http://www.amazonia.ch website are deducted directly from the invoice amount. Promotional discounts and loyalty points or any other form of promotion are only valid as future invoice reductions. Loyalty points, promotional discounts and credit notes are valid for a maximum of twelve months after issue and expire without consideration or notice.

3.4. Offers on products are only valid as long as they are visible on the http://www.amazonia.ch website and within the limits of available stocks.

3.5 Amazonia.ch AG reserves the right to change prices and conditions at any time without notice.

3.6. Amazonia.ch AG cannot be held liable in the event of a computer bug that unknowingly alters the price of one or more items. Amazonia.ch AG reserves the right to cancel an order if the amount does not agree with the prices normally set for products and/or delivery charges.

Article 4 ORDERING

4.1. The order becomes final upon acceptance by Amazonia.ch AG. The customer will receive an order confirmation by e-mail.

4.2. In the event of exceptional circumstances, in particular insolvency or incorrect information, Amazonia.ch AG reserves the right to refuse a customer’s order.

4.3 Amazonia.ch AG shall not be liable for any computer bugs that unknowingly affect the order. Amazonia.ch AG reserves the right to cancel an order if the amount does not agree with the prices normally set for the products and/or delivery charges.

Article 5 PAYMENT

5.1. Payment is made via Twint, credit card or PayPal

Article 6 SECURE PAYMENT AND DATA PROTECTION

6.1. All payments are secure. The information entered for payment is encrypted (https) and transmitted to PayPal securely in accordance with PCI standards. Amazonia.ch SA has no access to this information.

6.2. Amazonia.ch AG uses personal customer data in accordance with current legislation, in particular the Data Protection Act. All data is treated confidentially and securely.

6.3. Amazonia.ch SA processes and stores only the data required for the proper performance of its services and for billing purposes. The personal data stored is used to facilitate the purchase of new items by the customer and to ensure the smooth running of the business transaction. Under no circumstances will this data be passed on to third parties.

6.4. Google Analytics: This website uses Google Analytics, a web analysis service provided by Google Inc (“Google”). This service uses cookies to help the website analyze how users use the site. You can disable the use of cookies by selecting the appropriate settings on your browser. However, such deactivation may prevent you from using certain functions of this website.

Article 7 DELIVERY

7.1. Products are sent to the delivery address indicated by the customer during the ordering process. By transmitting the order, the customer acknowledges having read and accepted the general terms and conditions of sale.

7.2. Amazonia.ch SA has delegated the delivery of products to external partners. Items are generally available and delivered within 2 to 5 working days. If an item cannot be delivered, the customer will be informed by email.

7.3. In Switzerland, there are no deliveries on Sundays or on national and cantonal public holidays.

7.4. Amazonia.ch AG’s delivery times are approximate. Amazonia.ch AG makes every effort to meet them. However, failure to meet delivery dates shall not entitle the customer to cancel the order or to claim compensation or penalties for late delivery.

7.5. Amazonia.ch AG is not responsible for the theft of goods once they have been deposited by the post office. If there is any doubt about the security of the letterbox, it is the customer’s responsibility to request a signature. Upon delivery of the goods or their deposit in front of the customer’s domicile, the benefits and risks (in particular of theft, deterioration by third parties, bad weather) are transferred to the customer.

7.6. Delivery notes and invoices are sent electronically whenever possible.

Article 8 DELIVERY COSTS

8.1. Packaging and shipping costs are at the customer’s expense. They are indicated in the “basket” section of the order form and are calculated according to the country of delivery. Please refer to the “SHIPPING CONDITIONS” section for detailed information.

8.2. The quantity actually delivered is shown on the delivery note and the invoice. In the event of shortages or reduced quantities, the customer is not entitled to compensation or damages. If an invoiced item cannot be delivered, the corresponding amount will be refunded to the customer. There is no re-delivery and the customer has no claim for damages.

Article 9 OWNERSHIP

9.1. The goods remain the property of Amazonia.ch AG until payment has been received.

Article 10 RIGHT OF RETURN

10.1. It is the customer’s responsibility to check the merchandise upon delivery. In the unfortunate event of goods arriving in poor condition, Amazonia.ch AG will process the case within 48 hours of receipt of proof of the damaged goods by email, together with an explanation of the damage.

10.2 If the customer orders in error, the goods will not be returned or refunded.

Article 11 APPLICABLE LAW AND LEGAL FORCE

11.1 Swiss law applies to these general terms and conditions of business and to any contracts concluded pursuant to them.

Article 12 MODIFICATIONS TO GENERAL TERMS AND CONDITIONS

12.1. Amazonia.ch SA reserves the right to modify these terms and conditions at any time.

12.2. It is the customer’s responsibility to regularly inform themselves of the content and any changes to these terms and conditions.
